Terms of Use

R90 Navigator is a sleep performance and rhythm coaching application based on the R90 method developed by Nick Littlehales. The Service provides personalized sleep rhythm plans, daily action guidance, coaching from R-Lo (an AI-powered assistant), lifestyle recommendations, and educational content designed to help you improve your sleep habits, daily rhythm, and overall recovery.

The Service is not a medical device. It is a wellness, education, and lifestyle tool. It has not been evaluated, cleared, or approved by any medical regulatory authority (including the TGA, FDA, MHRA, or equivalent bodies). The Service does not provide medical advice, does not replace healthcare professionals, and is not intended for emergency use.

The Service includes R-Lo, an AI coaching assistant, and other automated features that generate personalized recommendations, messages, and insights. You acknowledge and agree that:

• All AI-generated content is produced by automated systems, not by human coaches, doctors, or sleep specialists.
• AI-generated content may be inaccurate, incomplete, or unsuitable for your particular circumstances.
• AI-generated content is provided for informational, educational, and wellness purposes only and should not be relied upon as professional advice.
• You should exercise your own judgment and, where appropriate, seek professional guidance before acting on any AI-generated recommendation.

You must be at least 16 years of age to create an account and use the Service. By using the Service, you represent and warrant that you meet this age requirement.

You are responsible for:

• Maintaining the confidentiality and security of your account credentials
• All activity that occurs under your account
• Providing accurate, current, and complete information
• Promptly updating your information if it changes

You agree not to:

• Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Service
• Copy, modify, distribute, or create derivative works based on the Service
• Use the Service for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to the Service, other user accounts, or our systems
• Use automated tools (bots, scrapers) to access or interact with the Service
• Interfere with or disrupt the Service or its infrastructure
• Transmit malware, viruses, or other harmful code
• Impersonate another person or misrepresent your identity
• Submit sensitive medical records, emergency information, or clinical data that the Service is not designed to process

6.1 Subscription Plans

The Service may offer free features and paid subscription plans (“Premium”). Premium features, pricing, and availability are described within the App and may change from time to time.

6.2 Billing

All subscription purchases are processed through the Apple App Store or Google Play Store (collectively, “App Stores”). By purchasing a subscription, you agree to the payment terms presented at the time of purchase and the applicable App Store terms. We use RevenueCat as subscription management infrastructure.

6.3 Free Trials

We may offer free trial periods. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the displayed price. You can cancel during the trial at no cost.

6.4 Auto-Renewal

Subscriptions automatically renew at the end of each billing period (weekly, monthly, or annually, depending on the plan selected) unless cancelled at least 24 hours before the end of the current period. The renewal price will be the same as the original subscription price unless we notify you of a price change in advance.

6.5 Cancellation

You may cancel your subscription at any time through the App Store subscription management settings on your device. Cancellation takes effect at the end of the current billing period. You will retain access to Premium features until that date. Deleting the app from your device does not automatically cancel your subscription.

6.6 Refunds

Refund requests are handled by the applicable App Store in accordance with their refund policies. We do not process refunds directly. Nothing in this section limits your rights under applicable consumer protection laws.

6.7 Price Changes

We may change subscription pricing at any time. Existing subscribers will be notified of any price changes before their next renewal date and will have the opportunity to cancel before the new price applies.

The R90 method is proprietary and is used under licence from Nick Littlehales. All content, software, algorithms, designs, the R-Lo character, trademarks, and other intellectual property in the Service are owned by or licensed to R90 Sleep Pty Ltd.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service on your personal device for your personal, non-commercial use. This licence does not include the right to:

• Sublicence, sell, or redistribute the Service or its content
• Use R90 or R-Lo branding, trademarks, or content outside the Service
• Use the R90 method or related materials for commercial purposes
• Reproduce, distribute, or publicly display coaching content, video or audio materials, or R-Lo responses

You may provide information, data, feedback, or other content through the Service (“User Content”). You are solely responsible for the accuracy and appropriateness of your User Content. You agree not to submit content that is abusive, unlawful, harmful, misleading, or that infringes on the rights of others.

We may remove User Content or suspend accounts if we reasonably believe content violates these Terms. You should not submit sensitive medical records or emergency information through the Service.

9.1 Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• Any defects will be corrected
• The content or recommendations will be accurate, complete, or reliable
• The Service will meet your specific requirements or expectations
• Any particular sleep, wellness, or performance outcome will be achieved

9.2 Limitation of Damages

To the maximum extent permitted by law, in no event shall R90 Sleep Pty Ltd, its directors, officers, employees, affiliates, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, health outcomes, or goodwill, arising out of or in connection with your use of or inability to use the Service.

Our total aggregate liability for all claims arising out of or relating to these Terms or the Service shall not exceed the greater of: (a) the total amount you paid to us in the 12 months preceding the claim, or (b) AUD $100.

9.3 Consumer Protection

If you are an Australian consumer, you may have rights and remedies under the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement. Nothing in these Terms is intended to exclude, restrict, or modify those statutory rights. If you are a consumer in the EU or UK, nothing in these Terms affects your statutory consumer rights.

You agree to indemnify, defend, and hold harmless R90 Sleep Pty Ltd and its directors, officers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of a third party
• Any health or lifestyle decisions you make based on information from the Service

11.1 By You

You may delete your account at any time through the App's settings or by contacting us at hello@r90navigator.com. Upon deletion, your personal data will be removed in accordance with our Privacy Policy and Account Deletion Policy.

Deleting your account does not automatically cancel your subscription. Please cancel your subscription through your App Store settings before or after deleting your account.

11.2 By Us

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or if required by law. We may also discontinue the Service or any feature at any time.

11.3 Effect of Termination

Upon termination, your licence to use the Service is immediately revoked. Sections that by their nature should survive termination (including disclaimers, limitation of liability, indemnification, and governing law) will continue to apply.

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts of New South Wales, Australia, for the resolution of any disputes arising from these Terms or your use of the Service.

If you are a consumer in the EU or UK, this choice of law does not deprive you of the protection of the mandatory provisions of the law of your country of residence.

• Severability: If any provision is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions remain in full force.
• Entire Agreement: These Terms, together with our Privacy Policy, Subscription Terms, and all other policies referenced herein, constitute the entire agreement between you and R90 Sleep Pty Ltd regarding the Service.
• Waiver: Our failure to enforce any right or provision shall not be deemed a waiver of that right or provision.
• Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
• Changes: We may update these Terms from time to time. We will notify you of material changes and update the “Last updated” date. Continued use after changes constitutes acceptance.
